I think it’s de facto public domain due to being sampled so many millions of times without enforcement. It’s never been removed by Freesound moderators. Also, this uses the amen samples built in to the Korg electribe 2, not direct samples from the Winstons record.

The “Amen Brother” breakbeat is not public domain — the number of infringements is irrelevant, as is the source of the material. Copyright is held by Richard Lewis Spencer (renewed in 2011), which will expire 70 years after his death. He died in 2020, so it will be public domain in 2090.

Sure, but this is on Korg for including it in their drum machines. Maybe they recreated the hits from original material.

Exactly, the original sample is copyrighted but if its just the drum pattern that is reproduced by a drum machine its not as there seems to be reasonable consensus that drum patterns can *not* be copyrighted.
