Would it be legal to use samples from a recording like James Brown’s Funky Drummer or the Amen Break?

we’re not really lawyers here on this site and taking legal advice from a web forum for a music site is a Really Bad Idea.
For the terms of the site see a link at the bottom of every page. In there is says "For the avoidance of doubt, materials that infringe the rights of any third party (ie. materials used without express permission of the copyright owner) may not be used." VS |

Really, what makes this site fun is the samples here which can be used. In addition, freesound (I can’t remember the URL, but it’s easy to google) has a lot of samples you can use based on attribution, so that you can create a world of sounds from the things out there and available.
